ملخص:

ان الدين الإسلامي كان سباقا إلى التكفل بضمان حق غير المسلمين في ممارسة الشعائر الدينية،ووضع لذلك ضوابط تجسد كل قيم التسامح بين مختلف الأديان

وجاءت ورقتنا البحثية تحت عنوان الآخر الديني ودوره في ضبط العلاقات القانونية الإجتماعية بين المسلمين وغير المسلمين.

وذلك من خلال مبحثين:

المبحث الأول يتكلم عن كيف يؤثر الآخر الديني في ضبط المعاملات في إطار قواعد القانون الخاص بين المسلمين وغير المسلمين

المبحث الثاني يحلل كيف يؤثر الآخر الديني في ضبط المعاملات في إطار قواعد القانون العام بين المسلمين وغير المسلمين

Abstract:

The Islamic religion was a pioneer to ensure the guarantee of the right of non-Muslims to practice religious rites, and therefore set controls that embody all the values of tolerance between different religions.

Our paper was titled The Religious Other and its Role in Controlling Social Legal Relations between Muslims and Non-Muslims.

This is done through two sections:

The first section talks about how the religious other influences the control of transactions within the framework of the rules of private law between Muslims and non-Muslims

The second section analyzes how the religious other influences the control of transactions within the framework of the rules of common law between Muslims and non-Muslims.
